SSED Pty Ltd ("SSED", "we", "us") operates Truck SMS, EziComply and EziTruck. This notice explains what personal information we collect through the Service, where and how it is stored, who we share it with, how long we keep it, what we do to keep it secure, and what happens if something goes wrong. It is written to meet our obligations under the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth), in particular APP 8 (cross-border disclosure of personal information).
Depending on how your company uses Truck SMS, this can include:
This information is collected to operate the Service for the safety and compliance purpose your company uses it for — including meeting Heavy Vehicle National Law obligations such as fatigue management, maintenance management, and mass management record-keeping, and to support incident response and continuous safety improvement.
Truck SMS is hosted on Heroku (a Salesforce company), running on Amazon Web Services (AWS) infrastructure. The application and its database, which hold your operational and personal records (including driver work diary, fatigue, licence, training, and incident records), are stored and processed in the United States. Uploaded files and archived compliance records are stored in Australia (AWS Sydney region). Some of your personal information is therefore stored and processed on servers outside Australia, by these overseas providers, as a necessary part of delivering the Service to you.
Consent to overseas storage: Where you accept these Terms, you consent to your personal information being disclosed to and stored by Heroku and AWS in the United States, as described in this notice. You understand that:
The consent above applies only to the United States storage described in this section. We still apply the security measures described below regardless of where information is stored.
We use the following third-party service providers to deliver the Service. Each receives only the information it needs for its function:
Your company may also choose to connect Truck SMS to other services, such as accounting software (for example Xero, MYOB, QuickBooks or Reckon), telematics and GPS providers (for example Fleet Complete, Geotab, V-DAQ, Navman or TruckStop). EziComply, SSED's maintenance program, is connected to Truck SMS by default. EziTruck, SSED's driver-facing app, connects to Truck SMS and EziComply. We only send information to the other services listed above when your company sets up the connection, and we send only the data needed for that integration. Your company decides whether to connect them.
We do not sell personal information, and we do not disclose it to third parties for their own marketing.
Where information is no longer needed for any purpose, including the retention periods above, we delete or de-identify it.
Your company can export its records from the Service at any time while the account is active.
When an account is closed, we will remove the company's data from Truck SMS, including any archived records, and email a data export to the account contact. The email will make clear that the data has been removed from Truck SMS and that the export file is only available for one month. The export file is encrypted and stored in Australia (AWS Sydney). We keep it for one month from the date of the email, in case the email is not received, and then delete it. After that, the download link will no longer work and the data cannot be recovered from us.
Copies of the data may remain in our backups until those backups are replaced, as described in section 5. Your company is responsible for keeping any records it needs to meet its own legal obligations, using the export.
We take real, concrete steps to keep your information secure, including:
No system is completely immune to risk, and we don't claim otherwise — these are the specific measures actually in place, not a general assurance.
If we become aware of a data breach involving your personal information that is likely to result in serious harm, we will assess and respond in line with our Incident Response Plan and our obligations under the Notifiable Data Breaches (NDB) scheme in the Privacy Act 1988 (Cth) — including notifying the Office of the Australian Information Commissioner (OAIC) and affected individuals where required, and taking steps to contain and remediate the incident.
You can ask to access or correct personal information we hold about you by contacting us through your usual Truck SMS account contact, or through your employer if they administer your account.
Questions or concerns about privacy can be sent to SSED Pty Ltd, ABN 66 129 455 072, by email at info@trucksms.au or by phone on 1300 394 399.
We will acknowledge a complaint and do our best to resolve it within 30 days. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au.
We may update this notice as our practices or hosting arrangements change. Material changes will be notified through the Service or by email before they take effect.
