These Terms of Use ("Terms") govern access to and use of the Truck SMS platform ("Truck SMS", "the Service"), operated by SSED Pty Ltd ("SSED", "we", "us", "our"). By creating an account, logging in, or otherwise using Truck SMS, you agree to these Terms on behalf of yourself and, if applicable, the company that engaged you to use the Service.
SSED Pty Ltd owns and operates Truck SMS, EziComply and EziTruck. Truck SMS is the compliance platform. EziComply is SSED's maintenance program, and Truck SMS connects to it by default. Operators may also connect their own existing maintenance systems to Truck SMS through our API. EziTruck is the driver-facing app, which connects to Truck SMS and EziComply. Together they form one compliance system for your operation, and SSED is the legal entity you contract with for all three.
Truck SMS is a safety management system for Australian heavy vehicle operators, covering functions including driver fatigue and work-hours recording, vehicle maintenance, mass management, incident and risk management, training records, point-of-sale and delivery dispatch, and related compliance record-keeping.
The driver work and rest recording in Truck SMS is a fatigue and work/rest record-keeping feature. It is not approved by the National Heavy Vehicle Regulator (NHVR), and it is not an Electronic Work Diary. It does not replace the driver's National Work Diary. Drivers must continue to complete their National Work Diary as the Heavy Vehicle National Law requires.
Truck SMS is a tool to help you keep records and manage safety. It does not replace your own obligations under the Heavy Vehicle National Law, Chain of Responsibility duties, or work health and safety laws, and it does not make your business compliant on its own. Operators remain responsible for how they use the Service and for the accuracy of what they record in it.
Subject to these Terms and payment of the fee for the Service, which is the monthly fee for your vehicle band shown on our pricing page (or the quoted fee for enterprise fleets) plus GST, SSED grants you a limited, non-exclusive, non-transferable licence to access and use Truck SMS for your own internal business or work purposes, for as long as your account remains active. This licence does not permit you to resell, sublicense, reverse-engineer, scrape, or build a competing product from the Service, or to use it for any purpose other than the safety, compliance, and operational functions it is designed for.
You must:
We may suspend or terminate access for accounts used to breach these Terms, applicable law, or in a way that risks the security or integrity of the Service or other users' data.
Truck SMS — including its software, design, branding, and underlying compliance procedure content — is owned by SSED Pty Ltd and its licensors and is protected by copyright and other intellectual property laws. Nothing in these Terms transfers any ownership of the Service to you. All rights not expressly granted are reserved.
Data you or your company enter into Truck SMS (driver records, vehicle data, incident reports, and similar operational content) remains your company's data. We do not claim ownership of it, and use it only to provide the Service to you, as described in our Privacy & Data Storage Notice.
Using Truck SMS means personal and operational information — including driver work diary and fatigue records, licence and training details, incident reports, and vehicle and delivery data — is stored on our behalf by third-party hosting providers. Your operational and personal records are stored in the United States. Uploaded files and archived compliance records are stored in Australia. Full detail on what is collected, where it is stored, how it is secured, how long it is kept, how you can export it, and what happens if a data breach occurs is set out in our Privacy & Data Storage Notice, which forms part of these Terms.
Overseas storage consent. Where you accept these Terms, you consent to your personal information being stored and processed overseas, in the United States, as described in the Privacy & Data Storage Notice. You can withdraw this consent by closing your account, though that means you can no longer use the Service.
6.1 Availability. We aim to keep Truck SMS available and take reasonable steps to maintain the security and integrity of the Service, including regular backups and a documented incident response process. Subject to clause 6.2, we do not guarantee that the Service will be uninterrupted or error-free.
6.2 Statutory guarantees. Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Where the Service is supplied to a consumer, the consumer guarantees apply in full.
6.3 Your data entry. The Service relies on accurate and complete data entered by you. We are not liable for loss caused by data you enter incorrectly, or fail to enter, to the extent the loss is caused by that incorrect or missing data. This does not apply to loss caused by our own negligence, failure of the Service to store or process data correctly, or a breach of our obligations under these Terms.
6.4 Templates and sample content. Procedures, forms, training content, safety document templates and other sample content provided with the Service are guides only. You are responsible for reviewing, confirming and correcting that content so it reflects your operations and obligations.
6.5 Excluded losses. Clause 7.3 applies to this clause.
7.1 Statutory guarantees.
7.2 Business customers. Where you acquire the Service for a business purpose, and to the extent permitted by law, our liability for breach of a guarantee that cannot be excluded is limited, at our option, to:
7.3 Exclusions. To the maximum extent permitted by law, we are not liable for:
7.4 Cap on liability. Subject to clauses 7.1 and 7.5, our total aggregate liability to you arising out of or in connection with these Terms and the Service, whether in contract, tort (including negligence), under statute or otherwise, is limited to the lesser of:
7.5 Death, personal injury and fraud. Nothing in these Terms limits our liability for:
7.6 Your indemnity. You indemnify us against third-party claims to the extent they arise from your unlawful use of the Service, your breach of these Terms, or content you upload that you have no right to upload.
7.7 Your responsibility for compliance. You are responsible for your own compliance with the Heavy Vehicle National Law, Chain of Responsibility obligations and work health and safety laws, including for the accuracy and completeness of the records you create or rely on in the Service. The Service is a tool to help you keep those records. It is not legal advice and does not guarantee compliance.
7.8 Acknowledgement of risk. You acknowledge that the Service is not a substitute for your own safety systems, supervision or judgement, and that decisions made about drivers, vehicles, loads and journeys remain yours.
7.9 Survival. This clause survives termination of these Terms.
We may update these Terms from time to time. Material changes will be notified through the Service or by email before they take effect. When a change is material, you will be asked to read and accept the updated Terms before you can continue using the Service. If you do not accept them, you may close your account.
These Terms are governed by the laws of Queensland, Australia.
